March Spring 2025 Giveaway

1. All participants must be at least eighteen (18) years of age and must be legal residents of the USA or DC (“Participant” or “you”). Winners (as defined below) will be announced on March 5, 2025 and notified via the Instagram account of which they tagged the Post (as defined below). Participant must respond to GlassesUSA’s notice of having won the Contest within three (3) days.
2. To participate in the Contest:
   • Participants must follow GlassesUSA’s Instagram account.
   • Participants must 'like' and 'comment' on the giveaway post, tagging another account.
   • Participants must share the giveaway post to their Instagram Stories.
   • Two participants will be declared the winners. One who comments, and the second who is tagged by the first.
3. By accepting the Prize – except where legally prohibited – you grant permission for GlassesUSA and its designees to use your name, address (city and state), photograph and/or other likeness and Prize information for advertising, trade, and promotional purposes relating to the Contest, without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval.
4. Winners shall be responsible for all federal, state and local taxes associated with acceptance and use of the Prize as well as any other costs and expenses associated with the Prize. The potential Winner may also be required for tax purposes to sign an affidavit and release and submit a W-9 tax form.
5. This Contest is not open to employees of GlassesUSA and/or its affiliates, agents or anyone connected with execution or administration of the Contest. Winners of the Contest shall receive a single pair of frames from the GlassesUSA website at: valid through December 31, 2025.
6. Please note that Winners may be required to pay shipping costs. The Prize is non-transferrable to another individual or business and may not be redeemed in any other manner. No adjustments may be applied on prior purchases and no discount shall be applied to any lenses upgrades. To redeem the Prize, Winners shall enter the designated coupon code provided by GlassesUSA in the shopping cart (such code is case-sensitive and must be entered exactly as it is provided). The Prize cannot be: (i) used for gift card purchases and\or (ii) combined with any other offers or discounts. Prize may not be redeemed for cash or cash equivalent and is subject to changes or expiry without notice. The contest is valid in the US only.
7. To receive the Winners list, you may email GlassesUSA at community@glassesusa.comThe winner list will include the winners’ first name and last name, which shall be available after all Winner confirmations are complete.
8. GlassesUSA reserves the right to alter, amend, suspend, or cancel this Contest, in whole or in part, at any time without notice. GlassesUSA’s decisions in respect of all aspects of the Contest will be final and binding.
9. By participating, you release and hold harmless GlassesUSA and its parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all others associated with the development and execution of the Contest from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Contest and/or the acceptance, awarding, receipt, use and/or misuse of the Prize, and you agree that these entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize except as expressly provided in these Contest T&C. Further, by participating, you agree that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any Prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney’s fees; (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise.
10. The failure of GlassesUSA to comply with any provision of these Contest T&C due to an act of God, hurricane, war, fire, riot, earthquake, pandemic, terrorism, act of public enemies, actions of governmental authorities outside of its control or other force majeure event will not be considered a breach of these Contest T&C. The Contest is subject to all applicable federal, state and local laws, and is void in Rhode Island and where prohibited or restricted by law. By participating in the Contest, the Participant agrees: (a) to abide by and be bound by these Contest T&C and decisions of GlassesUSA which shall be final in all respects relating to the Contest, including without limitation the interpretation of these Contest T&C; (b) to abide by and be bound by any terms of use, privacy policies, or other policies of any social media platforms; (c) the laws of the United States and the State of New York apply to and govern the Contest and any claims must be raised and resolved in the federal or state courts located in New York, NY, United States; (d) if, for any reason whatsoever, the Contest, in GlassesUSA’s sole opinion, is not capable of running as planned, including, but not limited to, to comply with legal requirements or by reason of infection by computer virus, tampering, fraud, technical failures, or any other cause which, in GlassesUSA’s sole judgment, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, GlassesUSA reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by GlassesUSA in its sole discretion; (e) if such cancellation, termination, modification or suspension occurs, notification will be posted on the GlassesUSA’s website; (f) GlassesUSA reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the operation of the Contest, or to be acting in violation of the terms of this or any other Contest; (g) any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and, should such an attempt be made, GlassesUSA reserves the right to seek damages from any such person to the fullest extent permitted by law; (h) GlassesUSA is not responsible for late, incomplete, misdirected, delayed, or undelivered entries, or entries not timely received due to Internet or website failures and disruptions, and ISP problems; (i) submission of incomplete information may result in disqualification of entry; (j) in the event of a dispute as to any entry, the authorized account holder of the Instagram account used to enter will be deemed to be the Participant. The potential Winner may be required to show proof of being the Instagram account holder; and (k) GlassesUSA’s failure to enforce any term of these Contest T&C shall not constitute a waiver of that provision.
11. Any personal data you provide in connection with the Contest to GlassesUSA will be treated in accordance with GlassesUSA’s Privacy Policy.
12. This Contest is in no way sponsored, endorsed, or administered by, or associated with, Instagram. By entering to the Contest, you confirm the release of Instagram of responsibility and agree to Instagram’s Terms of Use.
